The following data protection declaration applies to the UTP AG website, in particular to the website at www.underwear-shop.ch.

Based on Article 13 of the Swiss Federal Constitution and the data protection provisions of the Swiss Confederation (Data Protection Act, DSG), every person is entitled to protection of their privacy and protection against misuse of their personal data. We comply with these provisions. Personal data is treated as strictly confidential and is not sold to third parties. In close cooperation with our hosting providers, we endeavor to protect the databases as well as possible against unauthorized access, loss, misuse or falsification.

Access data/ server log files

We (or our web space provider) collect data about every access to the website (so-called server log files). The access data includes

• Volume of data transferred
• Notification of successful retrieval
• Browser type and version
• the user's operating system
• Referrer URL (the previously visited page)
• IP address and the requesting provider.

The provider uses the log data only for statistical evaluations for the purpose of operation, security and optimization of the offer. However, the provider reserves the right to check the log data retrospectively if there is a justified suspicion of unlawful use based on concrete evidence.

Handling of personal data

Personal data is information that can be used to identify a person, i.e. information that can be traced back to a person. This includes the name, email address or telephone number. However, personal data also includes data about preferences, hobbies, memberships or which websites have been viewed by someone.

When visiting this website, each user is assigned a user ID and stored in a cookie. This user ID is used to save items in the shopping cart, recently visited pages, the cookie selection and other personal settings so that they can be displayed again the next time the page is accessed or if the user returns within a few weeks or months.

Short-term session data is stored when the website is accessed, e.g. to recognize the login status and selected payment and delivery options. This data disappears when you log out, close the browser or after a few hours of inactivity.

Personal data is passed on to the transport company commissioned with the delivery or the corresponding financial service provider as part of the contract processing, insofar as this is necessary for the delivery or payment of the goods.

Shipping

Shipping is carried out by Swiss Post AG, Wankdorfallee 4, 3030 Bern. For this purpose, the delivery address is transmitted to Post AG.

Electronic payment

When choosing an electronic payment method (credit card, Twint, PayPal, ...), a connection is established to our payment service provider Datatrans AG, Kreuzbühlstr. 26, 8008 Zurich with order number reference, which then collects the data required for payment or forwards it to a financial service provider. UTP AG does not store any credit card information itself.

Invoice payment, credit information

If the payment method invoice is selected, UTP AG may obtain credit information about the customer and may forward customer data to CRIF AG, Hagenholzstrasse 81, 8050 Zurich for this purpose. If payment is received via bank payment/mail/ESR, we process payment information from the bank or post office with personal data of the payer.

Debt collection

Invoices not paid within the deadline will be assigned to Ideal Payment AG, Europa-Strasse 19, 8152 Glattbrugg ZH.

Contacting us

When contacting us (e.g. via contact form or e-mail), the user's details are stored for the purpose of processing the inquiry and in the event that follow-up questions arise. In the case of telephone contact, additional notes can be stored in orders and customer accounts.

Customer account and checkout as a guest

When opening a customer account, the user secures access to his stored data via a password of his choice and can then view address data, contents and delivery status of his orders as well as his chat log with customer service at any time.

When using a guest checkout without a password or ordering via other channels (telephone, post, marketplaces, etc.), a customer account is also created in order to store the address data required to process the order. As the customer has no online access without a password, requests for access to data must be made in writing to the customer service department with a copy of an official form of identification.

Right to data deletion

Items in the shopping cart and recently visited items can be deleted using the respective X button. Customer accounts without orders, payments and credit balances can be deleted on request to customer service. Once a contract has been concluded (e.g. through an order or payment), the store operator is obliged to retain billing and delivery data for warranty and tax purposes. Address data can therefore not be deleted within the legal obligations. Data which is required for the documentation of benefits claimed (vouchers, coupons) or for the defense against claims in the event of disputes can also not be deleted.

By changing your address or access data yourself or requesting this from customer service, you make it impossible to locate your orders and thus waive all return and warranty claims as well as any benefits associated with the changed data.

Newsletter and notifications

By providing their e-mail address in the login form or when opening a customer account, the user agrees to receive e-mail notifications in connection with their order. These may be order confirmations, delivery confirmations, information on delivery delays, information on payment transactions, quality control or communication with our customer service.

By providing the e-mail address in the newsletter registration or by completing a newsletter registration via the customer account, the user agrees to receive advertising from the store via e-mail. This consent can be revoked at any time via a link in the footer of the newsletter or via the newsletter button in the customer account.

Integration of third-party services and content

It may happen that third-party content, such as videos from YouTube, maps from Google Maps, RSS feeds or graphics from other websites are integrated into this online offering. This always presupposes that the providers of this content (hereinafter referred to as "third-party providers") are aware of the user's IP address.
